Welcome to Savio

These Terms of Service ("Terms") are a legal agreement between you and Savio ("we," "us," or "our"). By accessing or using the Savio mobile application ("App") and related services ("Services"), you agree to these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

1. About Savio

Savio is an AI-powered study companion that helps you analyze content, create study materials, and organize your learning.

Key Features:

  • Content analysis and summarization
  • AI-generated flashcards, quizzes, and summaries
  • Study planning and organization
  • Content import from websites and documents

2. Eligibility

2.1 Age Requirements

You must meet these age requirements:

  • Users of all ages may use the App
  • If you are under 13: You must have parental permission and direct supervision
  • If you are 13-17: You should have parental permission to use the App

Parents/Guardians:

  • You are responsible for your child's use of the App
  • You must monitor and supervise minors
  • You agree to these Terms on behalf of your child

2.2 Account Authority

You represent that:

  • You have the legal capacity to enter into this agreement
  • You will comply with all applicable laws
  • Your use will not violate any third-party rights

3. Your Account

3.1 Account Creation

Registration Options:

  • Email and password
  • Guest mode (device-specific, no account required)

Account Requirements:

  • Provide accurate information
  • One account per person
  • Keep credentials secure
  • Notify us of unauthorized access

3.2 Guest Accounts

  • Guest accounts are device-specific
  • Data is not transferable between devices
  • Data may be lost if app is uninstalled
  • Create a full account to preserve your data

3.3 Account Security

You are responsible for:

  • All activity under your account
  • Keeping your password confidential
  • Notifying us immediately of unauthorized access

We are not liable for:

  • Losses from unauthorized account access
  • Sharing your credentials with others

4. Subscriptions and Payments

4.1 Subscription Plans

We offer:

  • Monthly subscriptions
  • Annual subscriptions
  • Free trials for new users

All subscriptions include:

  • Monthly credit allocations
  • Access to all features
  • Automatic renewal

4.2 Pricing

  • Prices are in US dollars
  • Prices are subject to change with notice
  • All payments are processed through Apple's App Store
  • Applicable taxes may apply

4.3 Free Trials

New users receive:

  • A free trial period (duration specified at signup)
  • Full access during the trial
  • No charges until trial ends

Important:

  • You must cancel before trial ends to avoid charges
  • Cancellation takes effect at period end
  • One free trial per user

4.4 Automatic Renewal

Your subscription automatically renews unless:

  • You cancel before the renewal date
  • Payment fails
  • We terminate your account

Renewal Details:

  • Charged to your Apple account
  • At the current subscription price
  • 24 hours before period ends

4.5 Cancellation

How to Cancel:

  1. Open iPhone Settings
  2. Tap your name at the top
  3. Tap Subscriptions
  4. Select Savio
  5. Tap Cancel Subscription

OR via App Store app → Account → Subscriptions

Important:

  • Cancellation takes effect at the end of current period
  • No refunds for partial periods
  • You keep access until period ends
  • Unused credits are forfeited upon cancellation

4.6 Refunds

Apple Refund Policy:

  • All purchases are through Apple
  • Refund requests must be made to Apple
  • Contact Apple within their eligible refund period
  • We cannot process refunds directly

Our Policy:

  • Credits are non-refundable once used
  • Subscriptions are non-refundable except as required by law

5. Credits System

5.1 How Credits Work

Credits are required to:

  • Analyze content
  • Generate study materials
  • Process AI requests

Credit Consumption:

  • Credits are deducted when you start an analysis
  • Credits are consumed even if you cancel mid-analysis
  • Failed analyses may still consume credits

5.2 Credit Allocation

Free Users:

  • Receive initial free credits
  • Limited credits per month

Subscribers:

  • Receive monthly credit allocations
  • Credits refresh at the start of each billing period
  • Unused credits do NOT roll over

5.3 Credit Purchases

One-Time Purchases:

  • Available for non-subscribers
  • Processed through Apple App Store
  • Credits added immediately
  • Never expire

5.4 Important Credit Policies

Non-Refundable:

  • Credits cannot be refunded once used
  • Credits cannot be transferred
  • Credits cannot be redeemed for cash

Forfeiture:

  • Unused subscription credits expire at period end
  • Credits are forfeited if account is terminated
  • No compensation for unused credits upon cancellation

6. Acceptable Use

6.1 Permitted Uses

You may:

  • Use the App for personal study and learning
  • Upload content you own or have rights to use
  • Generate study materials for personal use
  • Share content you create (with attribution)

6.2 Prohibited Activities

You may NOT:

Content Violations:

  • Upload copyrighted content without permission
  • Upload content that infringes third-party rights
  • Upload illegal, harmful, or offensive content
  • Generate content for commercial purposes without authorization

System Abuse:

  • Use automated tools to bypass credit limits
  • Attempt to reverse engineer the App
  • Access systems or data without authorization
  • Interfere with App operations or other users

Account Violations:

  • Share your account credentials
  • Create multiple accounts to abuse free trials
  • Sell or transfer your account
  • Impersonate others

Harmful Activities:

  • Generate content that promotes violence or harm
  • Create content that harasses or bullies others
  • Distribute malware or malicious code
  • Violate any applicable laws or regulations

6.3 Enforcement

We may:

  • Remove violating content
  • Suspend or terminate your account
  • Report illegal activity to authorities
  • Take legal action for serious violations

7. Your Content

7.1 Content You Upload

Ownership:

  • You retain all rights to content you upload
  • You are responsible for your content
  • You must have rights to upload the content

License to Us: By uploading content, you grant us a license to:

  • Store and process your content
  • Generate study materials from your content
  • Display content back to you
  • Back up and secure your content

This license is:

  • Non-exclusive (you retain ownership)
  • Limited to providing the Services
  • Terminable when you delete content

7.2 Content Responsibilities

You represent that your content:

  • Does not violate any laws
  • Does not infringe third-party rights
  • Is not harmful or offensive
  • Is yours or you have permission to use it

You are liable for:

  • Any damages from your content
  • Legal claims related to your content
  • Violations of these Terms

7.3 Content Removal

We may remove content that:

  • Violates these Terms
  • Infringes third-party rights
  • Is illegal or harmful
  • Is reported by other users

We are NOT required to:

  • Monitor all user content
  • Pre-screen uploaded content
  • Review content before publication

8. AI-Generated Content

8.1 How AI Works

AI Processing:

  • Content is analyzed by artificial intelligence
  • AI generates summaries, flashcards, and quizzes
  • Processing happens on third-party AI servers
  • Results are returned to your account

8.2 AI Limitations

IMPORTANT - Please understand:

  • AI may make mistakes or provide inaccurate information
  • AI may "hallucinate" facts or create false information
  • AI may miss context or nuance
  • AI-generated content may be incomplete or outdated
  • We do NOT guarantee accuracy of AI outputs

8.3 Your Responsibility

You must:

  • Verify important information independently
  • Use critical thinking when reviewing AI content
  • Not rely solely on AI for critical decisions
  • Understand AI limitations

We are NOT responsible for:

  • Inaccurate AI-generated content
  • Decisions made based on AI outputs
  • Academic outcomes from using AI materials
  • Misunderstandings from AI content

8.4 AI Content Ownership

Generated study materials:

  • Are based on your uploaded content
  • Belong to you
  • Can be exported and used freely
  • Are not shared with other users

We do NOT:

  • Claim ownership of AI-generated materials
  • Use your AI outputs to train models
  • Share your study materials with third parties

9. Intellectual Property

9.1 Our Property

We own:

  • The Savio App and Services
  • Our trademarks, logos, and branding
  • The App's code, design, and features
  • All documentation and materials

You may NOT:

  • Copy or reproduce our App
  • Use our trademarks without permission
  • Modify or create derivative works
  • Distribute or sublicense our software

9.2 Your License to Use

We grant you a limited license to:

  • Install and use the App on your devices
  • Access the Services for personal use
  • Download your generated study materials

This license is:

  • Personal and non-commercial
  • Non-transferable
  • Revocable at any time
  • Subject to these Terms

9.3 Copyright Infringement

If you believe content infringes your copyright:

  • Email hello@savioapp.com with "Copyright" in subject
  • Include: Your contact information
  • Include: Description of copyrighted work
  • Include: Location of infringing content
  • Include: Statement of good faith belief
  • Include: Statement under penalty of perjury
  • Include: Your signature

We will:

  • Review your complaint
  • Remove infringing content if appropriate
  • Notify the uploader
  • Terminate repeat infringers

10. Third-Party Services

10.1 Services We Use

Third-party providers:

  • AI Providers: For content analysis
  • Apple: For payments and authentication
  • Cloud Hosting: For data storage
  • Analytics: For app improvement

10.2 Third-Party Links

The App may link to:

  • External websites
  • Third-party content
  • Other services

We are NOT responsible for:

  • Third-party content or services
  • Privacy practices of other sites
  • Accuracy of external information
  • Your interactions with third parties

Your use of third-party services is at your own risk.

11. Privacy

Your privacy is important to us.

  • By using the App, you agree to our Privacy Policy

Key points:

  • We collect minimal necessary data
  • We do not sell your information
  • We use industry-standard security
  • You can delete your data anytime

12. Disclaimers

12.1 "AS IS" Disclaimer

THE APP AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness
  • Uninterrupted service

12.2 No Guarantees

We do NOT guarantee:

  • The App will be error-free
  • Service will be uninterrupted
  • AI content will be accurate
  • Your academic success
  • Any specific results

12.3 Educational Disclaimer

The App is a study tool, NOT:

  • A substitute for proper study
  • Professional educational advice
  • A guarantee of academic performance
  • A replacement for teachers or tutors

You are responsible for:

  • Your own learning and study habits
  • Verifying information accuracy
  • Academic integrity in your work

13. Limitation of Liability

13.1 Liability Limits

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are NOT liable for:

  • Indirect or consequential damages
  • Lost profits or data
  • Service interruptions
  • AI content inaccuracies
  • Third-party actions
  • Unauthorized access to your account

13.2 Maximum Liability

Our total liability is limited to:

  • The amount you paid us in the past 12 months
  • OR $100 USD, whichever is less

13.3 Exceptions

These limitations do NOT apply to:

  • Death or personal injury from our negligence
  • Fraud or fraudulent misrepresentation
  • Violations that cannot be limited by law

Some jurisdictions don't allow these limitations, so they may not apply to you.

14. Termination

14.1 Termination by You

You may terminate by:

  • Deleting your account in App settings
  • Canceling your subscription
  • Uninstalling the App
  • Emailing hello@savioapp.com

Upon termination:

  • Your access ends immediately
  • Unused credits are forfeited
  • Your data may be deleted (see Privacy Policy)

14.2 Termination by Us

We may terminate your account if:

  • You violate these Terms
  • You abuse the Services
  • Required by law
  • For any reason with notice

We may immediately suspend without notice for:

  • Serious violations
  • Illegal activity
  • Security threats
  • Payment fraud

14.3 Effect of Termination

After termination:

  • You lose access to the App
  • Your content may be deleted
  • Unused credits are forfeited
  • No refunds for partial periods
  • Certain Terms survive (liability, disputes, etc.)

15. Changes to Terms

15.1 Our Right to Modify

We may change these Terms:

  • At any time
  • With or without notice
  • To comply with law
  • To add new features

15.2 Notification

We will notify you by:

  • Updating the "Last Updated" date
  • In-app notification
  • Email (for material changes)

15.3 Your Acceptance

Continued use after changes means you accept the new Terms.

If you disagree:

  • Stop using the App
  • Delete your account
  • Cancel your subscription

16. Dispute Resolution

16.1 Informal Resolution

Before any legal action:

  • Contact us at hello@savioapp.com
  • Describe the issue in detail
  • We will attempt to resolve within 30 days
  • Good faith negotiation required

16.2 Arbitration

If informal resolution fails:

  • Disputes will be resolved by binding arbitration
  • Arbitration conducted in India
  • One arbitrator
  • English language proceedings
  • Indian Arbitration and Conciliation Act applies

Arbitration covers:

  • All disputes arising from these Terms
  • All disputes related to the Services
  • All disputes between you and us

16.3 Exceptions to Arbitration

Not subject to arbitration:

  • Intellectual property disputes
  • Small claims court matters (below jurisdictional limit)
  • Injunctive relief requests
  • Any matter that cannot be arbitrated by law

16.4 Class Action Waiver

You agree:

  • No class or representative actions
  • Individual arbitration only
  • No consolidation of claims
  • No jury trial

If class waiver is unenforceable, arbitration clause doesn't apply.

17. Apple-Specific Terms

17.1 Acknowledgment

This App is made available through Apple App Store.

You acknowledge:

  • These Terms are between you and Savio (not Apple)
  • Apple is not responsible for the App
  • Apple has no obligation to provide support
  • Apple is not liable for any claims related to the App

17.2 License Scope

Your license to use this App:

  • Is limited to Apple iOS devices you own or control
  • Must comply with Apple's App Store Terms of Service
  • Is non-transferable
  • Terminates when these Terms end

17.3 Maintenance and Support

Savio (not Apple) is responsible for:

  • App maintenance
  • Support services
  • Addressing any claims
  • Compliance with applicable laws

17.4 Warranty

In case of App failure to conform to warranty:

  • Notify Apple for potential App Store refund
  • Apple has no other warranty obligation
  • We (not Apple) are responsible for warranty claims

17.5 Product Claims

We (not Apple) are responsible for:

  • Product liability claims
  • Legal or regulatory compliance
  • Consumer protection claims
  • Intellectual property infringement claims

17.6 Export Restrictions

You represent and warrant:

  • You are not in a US-embargoed country
  • You are not on any US restricted parties list
  • You will comply with all export laws

17.7 Third-Party Beneficiary

Apple is a third-party beneficiary of these Terms:

  • Apple can enforce these Terms against you
  • Apple has the right (deemed accepted) to enforce Terms
  • Upon your acceptance, Apple has enforcement rights

18. General

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

18.2 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

18.3 Severability

If any provision is found unenforceable, the remainder continues in effect.

18.4 No Waiver

Our failure to enforce any right does not waive that right.

18.5 Assignment

  • We may assign these Terms to another entity
  • You may not assign your rights without our consent

18.6 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

18.7 Survival

Provisions that should survive termination will continue (liability, disputes, intellectual property, etc.).
